Ibercóndor carries out all types of customs procedures for the AEAT (Tax Authority) by means of indirect representation, with regard to presentation and filing of documents, certificates and formalities, intervening on behalf of the client in accordance with articles 5 and 74 of the Customs Code and Article 199 of the Regulation CEE 2454/93.

Import/Export Clearance
Import clearance
Customs system that permits the physical entry of goods originating from a non- Community country into the customs territory of the Community.

Through the EDI system, we present the declarations to customs when the ship arrives, after verifying the information and documents with the shipping company, airline company, or customs premises where the goods are.

Our customs department is integrated within our organization, meaning it is not subcontracted, giving us increased agility and reliability,which results in a competitive edge for our clients.

Export Clearance
The customs exportation code permits the physical exit of Community goods to a non- Community.

Through the EDI system, we present the declarations to customs, after having verified that the goods are located in a customs site or in the Terminal.

Customs Transit
These are steps in a process, or customs procedures, that are used before the AGENCIA TRIBUTARIA, for goods that are not cleared, and require a Change of Customs request.

Ibercóndor utilizes the new computerized transit system NCTS (New Computerized Transit System). This software is based in the electronic exchange of information related to a transit among European customs offices involved in the operation (Customs office of departure– Customs office of transit – Customs office of destination).

Community Transit definition
Allows community goods to circulate from one place to another within the EEC customs territory, passing through the territory from an outside country, without modifying its customs status as community goods.

External Transit definition
Applied to goods with origin outside the Community, by virtue of which, the non-community goods can circulate from one point to another (from a departure customs to another destination), from community customs territory, without said goods being subject to import duties or indirect taxation, nor to EU commercial policy.

Post-clearance services / Guarantee of service
Ibercóndor carries out payment of the taxes on behalf of the importer via the Bank of Spain on the maturity of the same, as long as the importer doesn´t have the guarantee, presented before customs, or hasn´t carried out the previous payment of taxes.

Ibercóndor carries out follow-up on the management of incidents on behalf of the Administration for the four years following clearance finalization, with regard to the customs debt.

These incidents could be fines, records derived from changes of departure, declared value, foreign currency, quota reduction, cancellations, disputes, protestations, appeals and analysis.

All of this due to the fact that we hold official certification: we have been certified as AEOF(Authorized Economic Operator Full), loyal member of the Administration.

In the customs incidents related to clearance of exports, Ibercóndor has at its disposition a data communication system for the monitoring and management of some of these incidents without necessity of generating instances, and as a consequence, the error is instantly rectified.

Consultation on classification of goods

Tariff classification:
Know all the conditions and requisites to import or export as well as the duties, other taxes, licenses, inspections, certificates and administrative requirements.

Submission of IAV (Related Duty Information)
Is carried out in situations in which a foreign trade operator cannot determine with certainty the correct tariff classification of the goods to be exported or imported.

In these cases, a IAV document is requested from the Customs Authority. This document willofficially and unequivocally determine the tarriff classification, (linking the Administrations of the EU)
This information is managed directly through the Deputy General of Customs.


In Trade policy, the EU has an integrated system, with a common nomenclature. For the rest of the WTO (World Trade Organization) countries, the Harmonized System, in which only the first 4 or 6 digits are unified. Included is an additional service where rights of other countries can be obtained.
However, its always advisable to consult with an agent from the country.



Ibercóndor´s objective is to correctly guarantee and classify goods for the application of the customs declaration, protecting the interests of the client (with regard to inspections or proceedings that may arise during or after clearance), and always placing value on the technical and commercial aspects of the goods, to avoid ambiguities.


The classification of the goods is carried out through the customs rules , the CEE 2658/87 Regulations, of 23 July 1987, with regard to the presentation of a customs document to the customs authorities/Tax Authorities.

AEO
With regard to our Customs service, in November of 2009 we obtained the Community certificate A.E.O. from the Administration(Authorized Economic Operator) in its broadest category of Customs Simplification / Protection and Security, having entered to form part of a selection of the Administration´s trusted companies, with the corresponding advantages that this means for our clients.

It was fitting after all of these years collaborating closely with customs to provide social security and trust in the sanitation, economic and environmental realms.

The same year of the passing of the regulations in Spain (2008) we incorporated in our management the OEAF requirements, customs simplifications and Customs Security and Protectionappointing from the start a team made up of our Financial Director and RRHH, our Director of Information Technology and Security and our Director of Customs.

In 2009 Spanish Customs carried out an examination of the implemented measures via differentaudits in order to be considered for the status of Authorized Economic Operator.

On 2 November 2009 we were awarded this status, becoming an Operator considered trustworthy and secure for the rest of the members of the logistics chain in all of the European Union and including a large part of the world, assuming the following commitments:
  • Collaborate with the Administration in the fight against fraud.
  • Defend our clients and citizens against risks and dangers in the sanitary, economic and environmental realms.
  • Facilitate Secure Trade, minimizing risks and guaranteeing efficient logistics.
  • Raise awareness among our collaborators around matters of security, as well as our providers and clients.

Consulting on anti-dumping and safeguarding measures
"Anti-dumping" refers to trade defence measures applicable when a foreign provider engage in "predatory pricing," pricing goods lower than those that apply to the EU.

The investigation into possible dumping practices was initiated at the request of the affectedcompanies and is realized by the European Commission.
During the period of investigation, the Commission may impose provisional anti-dumping duties, such that importers should deposit a guarantee for the payment of the corresponding duties, or additional code in the applicable customs clearance section.

These guarantees will be effective in the case that the Council of Ministers of the EU reaches an accord in the imposition of definitive anti-dumping duties. The decisions of the Council of Ministers, in this case, are adopted by a simple majority of Member States.

It is a good idea to get informed prior to importation if the product has any anti-dumping implications, or the item is object of an investigation.

  • CITES INSPECTIONS
The CITES agreement (Convention on International Trade in Endangered Species of Wild Fauna and Flora) regulates the el trade in endangered species of fauna and wild flora and seeks the conservation of species by way of monitoring their trade.
  • PHARMACEUTICAL INSPECTONS
Sumbission of documentation for the Ministry of Health in drugs and cosmetics.
  • EXTERIOR HEALTH INSPECTIONS
Inspection of goods destined directly for human consumption .
  • VETERINARY INSPECTIONS
Consulting on everything related to products of animal origin , or intended for animal use.
  • PLANT INSPECTIONS

Monitor of products in matters of quality and labelling. Importation control according to Royal Decree 330/2008, published in March of 2008. See article 330/2008, and its expansion in March 2010 .

Our recommendation is:

1) Make sure that the labels that you are using are in accordance with valid regulations.

2) That the suppliers of materials destined for direct contact with the human body can guarantee the manufacturing process, as well as the dyes that are used, or any other modification that could damage the human body.

3) Periodically analyze, via the Homologated Laboratory in the case of importers/ traders, since they are responsible for the launching of the products into the marketplace.
